The South Dakota Supreme Court ruled for our clients, the owners of farmland, in removing a tenant that wouldn’t leave. South Dakota has special statutes that provide a shorter time frame for evictions to be completed. The tenant attempted to utilize delay tactics and drag out the litigation. The circuit court agreed with us and rejected these tactics.
The tenant, on appeal, sought to water down the eviction laws as a remedy for landowners to get their property back in a timely fashion. We were successful in both Circuit Court and in the Supreme Court in enforcing this special remedy chapter as written, which has significant protection for landowners from tenants that won’t vacate.
