Schoenbeck Law had the opportunity to serve with the Fredrikson & Byron firm on the Deuel Harvest case that was handed down on February 10, 2021.  A unanimous Supreme Court ruled for us in reversing the trial court, that had disqualified two members of the Deuel County Commission’s votes on a wind energy project. The Supreme Court held that the challenged commissioners, four of the five, did not have a bias that required their votes to be voided.  The principal statute on the issue of local government conflicts of interest was drafted by Senator Lee Schoenbeck fifteen years ago, in response to an earlier decision that caused confusion for local government officials.  The Fredrikson & Byron firm, located in Minneapolis, is very impressive on these wind energy cases.
